Privacy Statement

We understand that your trust in us is the most important asset of “Mapwave BV”, (hereinafter referred to as “Mapwave”, “we” or “us”). Mapwave is a brand name of Mapwave BV. As such, your privacy is essential to us.

Present privacy statement (hereinafter referred to as “Privacy Statement”) applies, among other things, to (i) our website www.mapwave.be (hereinafter referred to as the “Website”),(ii) visiting Mapwave’s premises and (iii) all (commercial) relations between Mapwave and its customers, prospects, business partners as well as those persons who have subscribed to the newsletter.

This Privacy Statement contains, among other things, information about the personal data Mapwave collects, as well as how Mapwave uses and processes that personal data.

Mapwave wishes to emphasize that it endeavors at all times to act in accordance with the “Privacy Legislation”, namely (i) the Belgian Privacy Act of December 8, 1992 on the protection of privacy with respect to the processing of personal data, (ii) the EU Regulation 2016/679 of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC and (iii) the (future) Belgian legislation on the implementation of the aforementioned Regulation.

Visiting the website, making use of Mapwave’s services, subscribing to the newsletter, registering for a Mapwave seminar or event as well as any and every form of communication with Mapwave implies your express approval (through communication of your personal data or opt-in) of the Privacy Statement and thus of the way Mapwave collects, uses and processes your personal data.

I. Types of personal data

Mapwave may collect and process the following personal data:

  • Email address
  • Phone number (landline and/or cell phone)
  • Residential address
  • Customer number
  • Cameras
  • Company name
  • Business address
  • Billing address
  • Social media data
  • Communication preference
  • IP address

All personal data contained in the free field of the contact form

All other personal data voluntarily transferred to Mapwave (e.g., during correspondence).

Mapwave also automatically collects anonymous information regarding the use you make of the website. For example, Mapwave will automatically log which parts of the website you visit, which web browser you use. We cannot identify you from this data, but it allows Mapwave to compile statistics regarding the use of the website.

II. Method of collecting personal data

This personal data is collected at or in connection with:

  • Website visit
  • A collaboration with Mapwave
  • Correspondence with and outgoing from Mapwave
  • Visiting the branch of Mapwave
  • Requesting a quote
  • Registering for a Mapwave seminar and/or event.
  • The use that you make of Mapwave’s services
  • Subscribing to Mapwave’s newsletter (whether through the website or physically)
  • Exchanging business cards
  • The verification of your identity

The personal data collected by Mapwave is thus expressly and voluntarily provided by you.

Providing certain personal data is (sometimes) a condition for enjoying certain services (e.g., to access certain parts of the website, to subscribe to newsletters, to participate in certain activities and events). It is hereby indicated which data are mandatory to fill in and which are optional.

III. Use of personal data

Mapwave may use your personal data for the following purposes:

  • The execution of an agreement with Mapwave (including its follow-up)
  • Answering questions (whether or not asked via contact form)
  • Optimizing the quality, management and content of the website
  • Sending newsletters
  • Statistical purposes
  • Formatting a quotation
  • Follow up after a meeting
  • Sending targeted marketing and advertising, updates and promotional offers based on your communication preference and – if applicable – based on your explicit approval
  • Conducting customer satisfaction surveys, surveys and other market research studies
  • Confirmation of registration for a Mapwave seminar and/or event
  • Sending invoices and collecting payments

Processing takes place on the following legal grounds, as appropriate:

You have consented to the processing of your personal data for one or more specific purposes.

The processing is necessary for the performance of the agreement with Mapwave or to take measures at your request prior to the conclusion of an agreement.

The processing is necessary to comply with a legal obligation imposed on Mapwave.

The processing is necessary to pursue the legitimate interests of Mapwave or a third party, except when your interests or fundamental rights and freedoms requiring protection of personal data outweigh those interests (especially if you are a minor)

IV. Disclosure of personal data to third parties

Mapwave will not disclose your personal data to third parties, except when necessary in connection with the performance of the agreement and its optimization (such as but not limited to processing payments, sending deliveries and in to provide services to Mapwave). In this context, your personal data may be disclosed to payment providers, software suppliers, cloud partner, transportation partners, external IT consultants, financial institutions, insurance companies, governmental and other legal authorities as well as external service providers.

If it is necessary for Mapwave to disclose your personal data to third parties for this purpose, the third party is obligated to use your personal data in accordance with the provisions of this Privacy Statement.

Notwithstanding the foregoing, however, Mapwave may disclose your personal information:

To the competent authorities (i) when Mapwave is required to do so by law or in the context of judicial or prospective legal proceedings, and (ii) to safeguard and defend Mapwave’s rights.

When Mapwave or substantially all of its assets are acquired by a third party, in which case your personal data collected by Mapwave will be one of the transferred assets.

In all other cases, Mapwave will not sell, rent or transfer your personal data to third parties unless it has(i) obtained your consent to do so and (ii) entered into a data processing agreement with the third party in question, which contains the necessary guarantees regarding confidentiality and privacy-compliant treatment of your personal data.

V. Cross-border processing of personal data

As a general rule, we do not transfer your data to recipients domiciled or based outside the European Economic Area. However, if this should become necessary, any transfer of personal data outside the European Economic Area (EEA) to a recipient who is resident or domiciled in a country not covered by an adequacy decision issued by the European Commission will be governed by provisions of a data transfer agreement, which will either (i) contain the standard contractual clauses set forth in the “Decision of the European Commission of February 5, 2010 (Decision 2010/87/EC)” or (ii) provide appropriate safeguards through any other mechanism under the Privacy Act or any other regulation governing the processing of personal data.

VI. Storage of personal data

Unless where a longer retention period is required or justified (i) by law or (ii) by compliance with another legal obligation, Mapwave will retain your personal data only for the period necessary to achieve and fulfill the purposes described in this Privacy Statement under “III. Use of Personal Data.

VII. Your privacy rights

In connection with the processing of your personal data, you have the following privacy rights:

Right to access your personal data;

Right to rectify, complete or update your personal data;

Right to have your personal data deleted (“right to be forgotten”) (Mapwave does remind you in this context that certain services will no longer be accessible or can no longer be provided if you delete or have deleted certain necessary personal data);

Right to limit the processing of your personal data;

Right to portability of your personal data;

Right to object/resist the processing of your personal data.

VIII. Personal data security

Mapwave undertakes to implement appropriate and reasonable physical, technological and organizational security measures to prevent (i) unauthorized or unlawful access to your personal data, as well as (ii) loss, misuse or alteration of your personal data.

Mapwave will store all personal data it has collected on the server at its site, as well as possibly in a back up Dropbox.

Notwithstanding (i) Mapwave’s security policies, (ii) the controls it implements and (iii) the actions it takes in this regard, a foolproof level of security cannot be guaranteed. No method of transmission or transfer over the Internet nor any method of electronic storage is 100% secure, so Mapwave cannot guarantee absolute security in this context.

IX. Privacy Statement Update.

Mapwave has the right to update this Privacy Statement by posting a new version on the website. It is this framework strongly recommended that you regularly check the websites and the relevant page on which the Privacy Statement appears to ensure that you are aware of any changes.
